1.2. When browsing the Site or making an online purchase through the Site, Customers declare that they have the legal capacity to do so.
2. General Provisions
2.1. The management and operation of the Stores and the Website, as well as all sales, are the responsibility of the company KINDA HOME PORTUGAL, S.A., headquartered at Avenida D. 3. Use on the Site and in Stores
3.1. Types of clients
3.1.1. General Customers - Customers will be able to explore the Site as general Customers, with general access to the Site not subject to any prior registration. Customers will be able to browse the Site and access the contents made available to the general public.
3.1.2. Registered Customers - To access an extra set of Site functionalities, general Customers may register on the Site by creating a customer account. For this purpose, the Customer must register by completing the registration form available on the Site, or by synchronizing with the Facebook social network.
3.1.3. Anonymous customers – The customer may also make a purchase through an anonymous customer, where the data used will not be kept by Kinda for purposes other than delivery and fulfillment of the order. It should be noted that in this type of customer, subsequent research related to the purchase (for example, change in billing, after-sales problems) may have other types of challenges with regard to the time taken to fulfill the order.
3.2. When creating a Customer account, the Customer is responsible for the accuracy and veracity of the data communicated to Kinda. In the event of non-compliance with these General Conditions or improper use of the Site, Kinda reserves the right to block or cancel the Customer's registration.
4. Site Contents
4.1. The images, videos, layouts, general and specific characteristics, as well as all other content presented on the Site are intended for use by the Customer within the scope of the functionalities made available on the Site, their copying, reproduction and or any use that goes beyond the scope of navigation in Kinda.
4.2. Kinda has implemented a set of information quality control procedures, aimed at transparency and impartiality in communicating with the Client, which is why it is our commitment to carry out all the necessary corrections whenever a publication error is detected.
4.3. The images presented are exclusively intended to illustrate the indicated items, not subject to any commercial transaction between the Customer and Kinda.
4.4. The Site has been optimized for viewing with a computer resolution of 1920x1080 or higher and in various resolutions for mobile devices (responsive), Kinda does not assume any responsibility, in any cases where viewing it proves to be deficient or even impossible.
4.5. The color tones of the product images displayed on the Customers' screen may look different from reality and depend on factors outside Kinda's sphere of responsibility, such as, for example, the characteristics of the Customer's computer equipment or the customization of the display characteristics on monitors. .
4.6. The accessories and complements shown in the photos are not included in the transactions carried out between Kinda and the Clients, except when expressly indicated.
4.7. Kinda is not responsible for errors that may occur due to system irregularities, temporary or permanent failure of the website or other tools. Any advice, recommendation or information of any kind, provided by Kinda, displayed or made available on the site, or obtained through use, is current, accurate, complete or error-free. It is our commitment to make all necessary corrections whenever a publication error is detected. Kinda informs that it assumes no legal duty in this matter.
5. Intellectual Property on the Site
5.1. Kinda reserves all intellectual property rights (including trademarks, logos, patents, copyrights, business secrets, among others) relating to the Site. Any content presented on the Site, in its digital and offline media, namely, information, images, photographs, videos, drawings, layouts or others, is owned by Kinda or licensed by third parties to Kinda. Browsing the Site as a Customer and/or creating a Customer account does not imply the transmission to the same of any intellectual property rights over said contents.
6. Limitation of guarantee of operation of the Site
6.1. The Site is made available as is, without any guarantee of functioning or suitability for any specific purposes and/or purposes envisaged by the Customer.
6.2. Kinda does not guarantee the uninterrupted or error-free operation of the Site, nor that it will be available at all times.
7.1. The prices and promotions on the Site are, in general, the same as the prices and promotions practiced in Kinda stores. However, there may be exclusive online promotions that will only be in force for periods of time duly identified in them.
7.2. The sales prices published on the Site and in the Stores are presented in euros. These prices include all legally required fees and taxes. Except when expressly indicated, the sales prices of published products do not include delivery and assembly services, and the total cost of the order, before payment, will be informed with delivery and assembly costs.
7.3. Kinda reserves the right to modify sales prices at any time. Such modification will be made in accordance with the legislation in force, with price modifications only valid for products ordered after the publication of the new prices.
7.4. If any of the items in an order placed have had a price reduction after the order was placed, the price difference in relation to the initial price will not be refunded.
8. Payment Methods on the Site
8.1. On the Site, the Customer can make payments through different methods: Multibanco reference, in which the order will only be processed after confirmation of payment and in which the initially scheduled delivery date may change depending on the time of payment; MB Way via smartphone; Paypal, having an account previously created for this purpose; Credit card, through the SIBS digital payment gateway.
8.2. If the Customer has not made full payment for the previous points within the indicated period, Kinda will be able to dispose of the item(s) in question, without the Customer having the right to be reimbursed for the deposit delivered.
8.3. Ownership of the item(s) is transferred to the Customer only on the date on which the following requirements are simultaneously fulfilled: full payment of the item(s) to Kinda; and delivery of the item(s) to the Customer.
